Terms of Service — Social Wizard AI
1. General & Acceptance of Terms
1.1 Service Name and Description
The service is "Social Wizard AI" — an AI-powered mobile application that helps users improve their social interactions. The app provides features including:
- Chat Helper — Analyze chat conversations and receive AI-powered guidance
- Reply Suggestions — Upload chat screenshots for smart reply suggestions
- Start Conversation — Get AI-generated conversation starters based on images or topics
- Awkward Situation — Receive AI-generated advice for handling awkward social situations
- Better Captions — Generate engaging captions for social media photos
1.2 Acceptance of Terms
By creating an account, accessing, or using Social Wizard AI ("the App," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App.
Your continued use of the App after any updates to these Terms constitutes your acceptance of the revised Terms.
1.3 Free vs. Premium Users
Social Wizard AI is a subscription-only service. Access to all core features requires an active premium subscription ("Premium"). There is no free tier. Users without an active subscription will be directed to the paywall and cannot access the App's AI-powered features.
2. User Eligibility
2.1 Minimum Age
You must be at least 16 years of age to use Social Wizard AI. If you are between 16 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
We do not knowingly collect personal information from children under 16. If we discover that a user is under 16, we will promptly terminate their account and delete any associated data.
2.2 Geographic Restrictions
Social Wizard AI is available worldwide. However, you are responsible for ensuring your use of the App complies with local laws in your jurisdiction. We make no representation that the App is appropriate or available for use in any particular location.
Users in the European Economic Area (EEA), United Kingdom, and California may have additional rights under applicable data protection laws (GDPR, UK GDPR, CCPA/CPRA). See Section 7 (Privacy & Data Usage) for details.
2.3 Account Limitations
Each user is limited to one (1) account. Creating multiple accounts to circumvent restrictions, bans, or subscription requirements is strictly prohibited and grounds for immediate termination.
3. AI-Generated Content
⚠️ THIS IS THE MOST IMPORTANT SECTION — PLEASE READ CAREFULLY
3.1 Ownership of AI-Generated Content
All AI-generated outputs — including reply suggestions, conversation starters, captions, situational advice, and chat analysis ("AI Outputs") — are generated by the Service using third-party AI models.
You (the user) receive a non-exclusive, worldwide, royalty-free license to use, copy, modify, and distribute the AI Outputs for your personal and commercial purposes, subject to these Terms. We do not claim ownership over the AI Outputs generated specifically for you.
However, you acknowledge that:
- Similar or identical AI Outputs may be generated for other users with similar inputs.
- AI Outputs are not guaranteed to be unique, original, or protectable under intellectual property laws.
- We retain the right to use anonymized and aggregated patterns from AI Outputs to improve the Service.
3.2 No Commercial License for Resale
You may not resell, redistribute, or commercially sublicense the AI Outputs as a standalone product or service (e.g., selling packs of AI-generated replies).
3.3 No Guarantees of Accuracy or Appropriateness
WE MAKE NO GUARANTEES WHATSOEVER regarding the accuracy, appropriateness, safety, effectiveness, or suitability of any AI Output. Specifically:
- AI Outputs may contain errors, inaccuracies, or factual mistakes.
- AI Outputs may contain biases (cultural, gender, racial, or otherwise).
- AI Outputs may include content that is offensive, inappropriate, insensitive, or socially unacceptable.
- AI Outputs may suggest replies or actions that lead to negative social outcomes.
- AI Outputs are not tailored to your specific emotional, psychological, or relational situation and should never be treated as personalized advice.
You use AI Outputs entirely at your own risk. You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated content before sharing it with others.
4. User Inputs & Prompts
4.1 Types of User Input
Users may provide the following types of content to the App:
- Text descriptions of social situations, contexts, and relationship details
- Screenshots of chat conversations (uploaded as images)
- Photos of people, activities, or scenes (for conversation starters and captions)
- Profile information (name, communication style/tonality preferences, language)
4.2 Right to Review, Store, and Reject
We reserve the right to:
- Store user inputs (prompts, uploaded images, and context) for the purpose of processing requests and enabling the history feature.
- Review user inputs (manually or through automated systems) for the purpose of identifying misuse, enforcing these Terms, and maintaining the safety of the Service.
- Reject or refuse to process any input that violates these Terms, contains prohibited content (see Section 5), or would cause the Service to generate harmful outputs.
4.3 Use of Inputs for AI Improvement
We do not use your individual prompts, uploaded images, or personal context to train or fine-tune our AI models. Your personal inputs remain your own.
However, we may use anonymized, aggregated, and de-identified usage data (such as feature usage frequency, error rates, and general content categories) to improve the Service and develop new features. No individual user's data will be identifiable in this process.
5. Prohibited Uses
You agree NOT to use Social Wizard AI for any of the following purposes:
5.1 Harassment and Abuse
- Generating replies intended to harass, bully, intimidate, threaten, or demean any person.
- Creating content designed to incite hate speech, discrimination, or violence against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
5.2 Deception and Manipulation
- Catfishing — Using AI-generated replies to impersonate someone else or create a false identity.
- Romance scams — Using the App to deceive, manipulate, or defraud others in romantic or intimate contexts.
- Impersonation — Generating content that falsely represents you as another specific person (celebrity, influencer, public figure, or private individual).
- Dating or romantic manipulation — Using AI Outputs to psychologically manipulate, gaslight, or coercively control another person in a romantic or dating context.
5.3 Spam and Automation
- Using the App for spam, mass messaging, or automated/bulk replies on any social media platform.
- Integrating the App's outputs into bots, scripts, or automated systems for mass distribution.
5.4 Illegal and Harmful Content
- Generating content that is illegal, defamatory, libelous, or fraudulent under any applicable law.
- Creating sexually explicit, pornographic, or obscene content.
- Generating content that promotes, glorifies, or incites violence, self-harm, or terrorism.
5.5 Professional Advice
- Using or representing AI Outputs as legal advice, medical advice, financial advice, therapeutic or psychological counseling, or any other form of professional advice.
- Claiming that AI Outputs constitute certified, licensed, or expert professional guidance of any kind.
5.6 Violations of Third-Party Terms
- Using AI Outputs in a manner that violates the terms of service of any third-party platform, including but not limited to Instagram, TikTok, WhatsApp, LinkedIn, Snapchat, Facebook/Meta, X (Twitter), or any other social media or messaging service.
Violation of any of these prohibited uses may result in immediate suspension or permanent termination of your account without refund.
6. Intellectual Property
6.1 Your Original Content
You retain full ownership of all original content you provide to the App, including your messages, uploaded images, text inputs, profile information, and personal context. By using the Service, you grant us a limited, non-exclusive, worldwide license to process and store your content solely for the purpose of providing the Service.
6.2 AI-Generated Content
As stated in Section 3.1, you receive a license to use AI Outputs generated for you. We do not claim ownership of AI Outputs generated in response to your specific inputs.
6.3 Our Intellectual Property
All rights, title, and interest in and to the App — including its design, branding, logos, code, algorithms, user interface, and underlying technology — remain the exclusive property of Social Wizard AI and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.
6.4 Content Involving Real People
You must not upload images of or generate content about real people (including celebrities, influencers, and public figures) without their consent, if the generated content could reasonably be mistaken as authentic communication from or endorsed by that person. Using the App to generate content that infringes on any third party's right of publicity, privacy, or intellectual property rights is strictly prohibited.
7. Privacy & Data Usage
7.1 Data Storage
User conversations, prompts, uploaded images, and generated results are stored locally on your device through the App's history feature. We process your inputs through our servers solely to generate AI Outputs.
We may store server-side logs for security, debugging, and abuse prevention purposes. These logs are retained for a limited period and are not used for AI training.
7.2 AI Training
We do not use your personal data, prompts, images, or generated outputs to train or fine-tune our underlying AI models.
7.3 Opt-Out Rights
Since we do not use personal data for AI training, there is no AI training to opt out of. However, users in applicable jurisdictions retain all rights regarding their personal data as described below.
7.4 Compliance with Privacy Laws
We are committed to complying with applicable data protection laws:
- GDPR (EU/EEA): Users have rights to access, rectify, erase, restrict, and port their personal data, and to object to processing. Data processing is based on legitimate interest and contractual necessity.
- UK GDPR: Same protections as GDPR apply to users in the United Kingdom.
- CCPA/CPRA (California): California residents have the right to know, delete, and opt out of the sale of their personal information. We do not sell personal information.
- Children's Privacy: We comply with COPPA (USA), GDPR Article 8 (EU), and equivalent regulations. Users must be at least 16 years of age.

8. Disclaimers & Risk Warnings
8.1 Not a Substitute for Human Judgment
Social Wizard AI is an entertainment and productivity tool only. The App is NOT a substitute for:
- Your own personal judgment and common sense
- Professional relationship counseling or therapy
- Legal, medical, financial, or psychological advice
- Genuine human empathy, understanding, and communication skills
You are always solely responsible for your own words and actions, whether or not they were inspired by AI Outputs.
8.2 Disclaimer of Liability for Harm
We expressly disclaim all responsibility and liability for any harm arising from your use of AI Outputs, including but not limited to:
- Emotional harm — hurt feelings, damaged relationships, rejection, misunderstandings, or emotional distress
- Reputational harm — embarrassment, social backlash, loss of reputation, or public humiliation
- Financial harm — lost business opportunities, financial losses, or economic damages
- Legal consequences — any legal action, claims, or penalties arising from your use of AI-generated content
8.3 Third-Party Platform Risks
⚠️ WARNING: Using AI-generated replies, captions, or messages on third-party platforms (including but not limited to Instagram, TikTok, WhatsApp, LinkedIn, Snapchat, Facebook/Meta, X (Twitter), and others) may violate those platforms' Terms of Service.
We are not responsible for any consequences resulting from your use of AI Outputs on third-party platforms, including but not limited to:
- Account suspension or permanent ban from third-party platforms
- Content removal or flagging
- Legal action taken by third-party platforms
You use AI Outputs on third-party platforms entirely at your own risk.
9. Limitation of Liability
9.1 Maximum Liability
To the maximum extent permitted by applicable law, our total, aggregate liability to you for all claims arising out of or relating to the use of the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars ($50.00 USD).
9.2 Exclusion of Damages
To the maximum extent permitted by applicable law, in no event shall we be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, business, or anticipated savings
- Loss of data or goodwill
- Emotional distress, mental anguish, or psychological harm
- Damages arising from reliance on AI-generated content
- Damages arising from the unauthorized access, use, or alteration of your content
Whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
9.3 Essential Purpose
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Payments & Subscriptions
10.1 Subscription Model
Social Wizard AI requires an active Premium subscription to access all features. Subscriptions are processed and managed through the Apple App Store and Google Play Store via RevenueCat.
10.2 Billing and Auto-Renewal
- Subscriptions are billed on a recurring basis (weekly, monthly, or annually, depending on the plan selected).
- Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
- Payment will be charged to your App Store or Play Store account at confirmation of purchase.
10.3 Free Trial
If a free trial is offered, it will be clearly indicated before purchase. If you do not cancel before the free trial period ends, your subscription will automatically convert to a paid subscription at the displayed price.
10.4 Cancellation
You may cancel your subscription at any time through your device's App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period — you will continue to have access until then.
10.5 Refunds
Refunds are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies. We do not process refunds directly. For refund requests, please contact the respective store.
11. Termination & Suspension
11.1 Grounds for Suspension or Termination
We may suspend or permanently terminate your account, without prior notice or refund, if:
- You violate any provision of these Terms
- You engage in any prohibited use (see Section 5)
- You attempt to circumvent, abuse, or manipulate the Service
- We are required to do so by law or regulation
- We determine, in our sole discretion, that your continued use poses a risk to the Service, other users, or third parties
11.2 Effect of Termination
Upon termination of your account:
- Your access to the Service will be immediately revoked.
- Any locally stored data (history, preferences) remains on your device unless you delete the App.
- Server-side data associated with your account will be deleted within 30 days, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention).
- You are not entitled to any refund for the remaining portion of your current subscription period, except where required by applicable law.
11.3 Voluntary Deletion
You may delete your account at any time. Upon voluntary deletion, the same data handling procedures described in Section 11.2 apply.
12. Miscellaneous (Legal)
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.
12.2 Dispute Resolution
Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us at our support email. If informal resolution is not possible within thirty (30) days, the dispute shall be submitted to the competent courts of the Slovak Republic, unless mandatory consumer protection laws in your jurisdiction require otherwise.
For EU consumers: You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
12.3 Changes to Terms
We reserve the right to modify these Terms at any time. When we do, we will:
- Update the "Last Updated" date at the top of this document.
- Notify users of material changes through an in-app notification or by email (if provided).
- For significant changes, provide at least 14 days notice before the new Terms take effect.
Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes.
12.4 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.5 Entire Agreement
These Terms, together with our Privacy Policy , constitute the entire agreement between you and Social Wizard AI regarding the use of the Service.
